On August 6, the U.S. Court of Appeals for the Fourth Circuit affirmed the preliminary injunction allowing PSEG to enter private property to conduct surveys before the Maryland Public Service Commission (PSC) has decided whether the Maryland Piedmont Reliability Project (MPRP) should be approved.
While we are disappointed by this decision, it is important to understand what it does—and does not—mean.
The ruling addresses survey access only. It does not approve the MPRP, authorize construction, or grant PSEG the authority to take private property for the project. Those decisions remain before the Maryland PSC, where the MPRP application continues to undergo review.
Stop MPRP is assisting the landowners named in the litigation as they review the Fourth Circuit's decision with legal counsel and determine their next steps. At the same time, we remain fully engaged in the Maryland PSC proceedings, advocating for landowners, promoting responsible alternatives, and ensuring that the voices of affected communities are heard.
